  Dear Friends:

Yesterday’s e-mail to you concerning my comment on Bill 286 was incorrect and merits further explanation.

During the floor debate on Bill 286, I had a technical concern about lease execution formalities that was cured on the floor with this amendment:

"Section 2. Approval of Lease Agreement. The lease agreement attached hereto and identified as "Appendix A," signed by I Maga’lahen Guahan on June 28, 2004 and transmitted to the Legislature on June 9, 2004, is hereby approved … (I added this next clause) provided that a Memorandum of Lease be recorded at the Department of Land Management no later than July 1, 2004, and attached thereto shall be a properly signed resolution authorizing the Guam Baseball Federation to enter into this lease and designating a selected officer to execute on behalf of the Guam Baseball Federation."

But, there were two policy matters that really should have been resolved but weren't. These questions are 1.) should the Guam Baseball Federation pay rent which equals 4% of accrued gross revenue each year; or should the rent be capped at $4,000 per annum? 2.) should the Guam Baseball Federation be able to “use” GovGuam classified employees to carry out maintenance functions at the Paseo Stadium?

My floor amendment to resolve 1.) and Sen. Brown’s to resolve 2.) were defeated along party lines.
